ACCEPTANCE AND FORMATION OF CONTRACT

BY MAKING A DOWNPAYMENT TO TRIM THAT TREE, LLC DBA TEXAS SLAB GUYS AND/OR SAFELIFT-HTX ("CONTRACTOR"), THE PERSON OR PERSONS MAKING PAYMENT (EACH A "CUSTOMER") CONFIRMS ACCEPTANCE OF THE PROPOSAL, ESTIMATE, JOB DETAIL SHEET, STANDARD TERMS & CONDITIONS AND LIMITED WARRANTY (TOGETHER THE "CONTRACT"). Customer acknowledges that this Contract constitutes a valid and enforceable agreement under Texas law, containing the required elements of offer, acceptance, and consideration.

CONFIDENTIALITY OF QUOTE

This proposal and contract are provided solely to the Customer identified. Customer agrees not to forward, disclose, or share the estimate, pricing, or terms with any third parties without Contractor's prior written consent. Unauthorized sharing of this document constitutes a material breach.

RESCHEDULING, REMOBILIZATION, TERMINATION

Rescheduling: $500 fee if rescheduled within 48 hours of scheduled service date.

Remobilization: $1,500 fee if Contractor must return due to Customer unpreparedness.

Termination: Customer may cancel prior to work starting and receive refund of deposit less $375.

CUSTOMER RESPONSIBILITIES

Customer shall: (1) make full payment upon completion of work; (2) prepare the work area; (3) be solely responsible for finish work such as landscaping, painting, etc.; (4) mark all private utility lines; (5) maintain positive drainage away from repaired areas; (6) keep gutters clean and functional; (7) direct downspouts away from repaired areas; (8) maintain proper expansion joints; and (9) comply with all 'Customer Will' or 'Additional Notes' items.

PAYMENT AND REMEDIES FOR NON-PAYMENT

The entire Contract amount is due upon completion. Late payments accrue interest at 1% per month (12% per annum) or the maximum lawful rate, whichever is less. In the event of non-payment, Customer is liable for Contractor's attorney fees, court costs, collection expenses, lien rights, and all associated enforcement remedies under Texas law.

LIEN RIGHTS AND COLLECTION

Customer expressly authorizes Contractor to file and perfect a lien against the serviced property to the maximum extent permitted by Texas law in the event of non-payment. Customer acknowledges and agrees that such lien may be assigned, transferred, or sold by Contractor to any third party without further consent from Customer. Customer further acknowledges that non-payment may result in referral to debt collection agencies, reporting to credit bureaus, and other lawful collection efforts.

LIMITED WARRANTY

Trim That Tree, LLC provides limited warranties as follows. Warranties are contingent upon full payment. Warranty coverage applies only to the specific area serviced, not adjoining slabs. Cosmetic cracks are excluded. Tree roots, drainage issues, soil movement, or natural forces void coverage. Warranty work will not address changes in adjoining slabs not serviced by Contractor. Contractor has up to twelve (12) months to perform warranty work, which may be scheduled outside peak season at Contractor's discretion.

IMPORTANT: Warranty is null and void if Customer posts a negative review (defined as four stars or less, or equivalent rating) on any online platform, including but not limited to Google, Yelp, Facebook, Instagram, TikTok, Medium, LinkedIn, Discord, or any other public or private platform, whether existing or created in the future.

Warranty or maintenance service calls may be subject to a $399 truck roll fee.

Texas Slab Guys Warranty

For concrete leveling services performed by Texas Slab Guys, Contractor warrants that for a period of ten (10) years from the date of completion, the serviced area will remain level within industry standards. If settlement occurs due to defective workmanship, Contractor will provide labor and materials to re-level the serviced area one (1) time at no additional cost.

SafeLift-HTX Warranty

For concrete leveling services performed by SafeLift-HTX, Contractor warrants that for a period of two (2) to five (5) years, depending on the scope of work as defined in the job detail sheet, the serviced area will remain level within industry standards. If settlement occurs due to defective workmanship, Contractor will provide labor and materials to re-level the serviced area one (1) time at no additional cost.

WARRANTY EXCLUSIONS

This warranty shall be void if: (1) Customer fails to maintain positive drainage; (2) property damage arises from tree roots or other root systems; (3) soil movement, water infiltration, flooding, or natural disasters occur; (4) adjoining slabs not serviced by Contractor shift; (5) Customer permits other contractors to alter Contractor's work; or (6) Customer fails to comply with payment obligations. Cosmetic cracks do not qualify for warranty service.

NEW CONCRETE SERVICES

For new concrete pours performed by either Texas Slab Guys or SafeLift-HTX, Contractor warrants that for a period of one (1) year from the date of completion, the poured slab will remain stable under normal conditions and usage. If settlement occurs due to defective workmanship, Contractor will provide labor and materials to repair the area one (1) time at no additional cost to the Customer. This limited warranty does not cover cosmetic cracks, discoloration, surface imperfections, or settlement due to inadequate subgrade preparation by others.

INSURANCE COVERAGE

Contractor maintains general liability insurance coverage in the amount of $250,000. This coverage is intended to protect against third-party claims. Customer acknowledges that such coverage does not insure Customer's property against ordinary risks, excluded damages, or losses outside the scope of Contractor's direct negligence.

FORCE MAJEURE

Contractor shall not be liable or responsible for any failure or delay in performance caused by events outside Contractor's reasonable control, including but not limited to acts of God, flood, fire, storm, earthquake, explosion, governmental actions, labor disputes, civil unrest, acts of terrorism, war, epidemic, pandemic, or interruptions in utility or transportation services. In such cases, Contractor's obligations shall be suspended for the duration of the delay. Customer acknowledges that such delays do not constitute breach of contract and may extend project timelines accordingly.

Privacy Policy

By submitting any information through this website, you consent to our collection, storage, and internal use of such data, consistent with our Privacy Policy, which is incorporated into these Terms by reference.

PROJECT PHOTOGRAPHY AND USE

We reserve the right to photograph all work performed, including before and after images. By engaging with us through any means (form, phone, referral, or otherwise), you grant us perpetual, royalty-free permission to use any images, names, likenesses, testimonials, or project references for marketing or advertising purposes, including on our website, printed materials, and digital campaigns.

OWNERSHIP AND USE OF CUSTOMER DATA

All data submitted to us, including but not limited to names, phone numbers, emails, and form content, is the sole property of SafeLift-HTX. We reserve the right to use this data for internal operations, marketing, customer service, and other business functions.

INTELLECTUAL PROPERTY

All content on this website—including text, graphics, videos, designs, and code—is owned or licensed by SafeLift-HTX and protected under intellectual property laws. You may not reproduce, distribute, display, or create derivative works from any part of the website without prior written consent.

WEBSITE USE AND RESTRICTIONS

You are granted a limited, non-exclusive, non-transferable license to use this website for personal, non-commercial purposes. You agree not to: Copy, modify, reverse engineer, or attempt to extract source code; use any automated system (e.g., bots, scrapers) to access the site; or use this website in any way that violates applicable laws or regulations. We may revoke your access at any time for any reason without notice.

MISCELLANEOUS

No joint venture, partnership, employment, or agency relationship exists between you and Texas Slab Guys as a result of these Terms or use of the website. If any part of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force. These Terms may not be assigned by you without our prior written consent. Our failure to enforce any provision shall not waive our right to enforce it in the future.

INDEMNIFICATION

You agree to indemnify and hold harmless SafeLift-HTX, its owners, employees, affiliates, and contractors from any claims, damages, or liabilities (including legal fees) arising from your use of the site, violation of these Terms, or any third-party claim related to content or information you submit.

GENERAL PROVISIONS

Entire Agreement: This Contract constitutes the entire agreement between the parties and supersedes all prior negotiations or discussions.

Severability: If any provision is held invalid, the remaining provisions shall remain enforceable.

Governing Law & Venue: This Contract is governed by the laws of the State of Texas. Venue for any dispute is Harris County, Texas.

Attorney's Fees: The prevailing party in any dispute shall recover reasonable attorney's fees and costs.

Assignment: Customer may not assign rights or obligations without Contractor's prior written consent.

Change Orders: Any changes must be agreed to in writing and signed by both parties.

Headings: Section headings are for convenience only and do not limit interpretation of provisions.

Limitation of Liability: Contractor's total liability shall not exceed the total amount paid by Customer for the services.

Notice Requirement: Pursuant to Chapter 27 of the Texas Property Code, Customer must provide written notice by certified mail at least 60 days before filing suit.

Dispute Resolution: Disputes shall be resolved by binding arbitration administered by the American Arbitration Association in Harris County, Texas.

LEVELESTIMATE™ — PROPRIETARY TOOL & RESTRICTIONS ON USE

Ownership

All rights, title, and interest in and to LevelEstimate™, including but not limited to its underlying logic, formulas, data structures, algorithms, pricing models, user interface, source code, design elements, and all outputs or calculations produced by it, are and shall remain the sole and exclusive property of Trim That Tree, LLC DBA Texas Slab Guys ("Contractor"). Nothing in this Contract or in any communication between the parties shall be construed as transferring or granting any license, right, or interest in LevelEstimate™, except for limited, temporary use as expressly permitted below.

Permitted Use

Any quote, estimate, or output generated by LevelEstimate™ is furnished solely for the use of the Customer identified on the document for the limited purpose of evaluating Contractor's services. The estimate and all associated data, calculations, or documentation are confidential and may not be disclosed, copied, shared, or relied upon by any other person or entity without Contractor's prior written consent.

Restrictions

Customer expressly agrees not to:

  • Copy, reproduce, modify, distribute, or disclose any portion of LevelEstimate™, its structure, or its outputs;
  • Reverse-engineer, decompile, derive, simulate, or otherwise attempt to reconstruct or replicate any portion of LevelEstimate™ or its pricing methodology;
  • Use any estimate, calculation, or output to create, train, or inform any competing or similar software, tool, or service;
  • Allow or enable any third party (including consultants, contractors, or competitors) to access or analyze LevelEstimate™ or its results for competitive or derivative purposes; or
  • Remove or obscure any proprietary notice, trademark, or copyright of Contractor.

Confidentiality and Non-Disclosure

Customer acknowledges that all data, calculations, pricing logic, and documentation related to LevelEstimate™ constitute confidential and proprietary business information of Contractor. Customer shall maintain strict confidentiality of all such information and shall take reasonable measures to prevent unauthorized disclosure or use. Any unauthorized use or disclosure shall constitute a material breach of this Contract.

Injunctive Relief and Damages

Customer agrees that any breach or threatened breach of this section would cause irreparable harm to Contractor, for which monetary damages may be inadequate. Contractor shall be entitled to seek injunctive relief, specific performance, and recovery of all costs and attorney's fees in addition to any other remedies available under Texas law.

No Warranties or Reliance

LevelEstimate™ provides pricing estimates based on Contractor's proprietary methodologies and assumptions. Estimates are not guaranteed and may vary due to project conditions or field verification. Customer acknowledges that LevelEstimate™ outputs are informational tools only and do not constitute a binding quote until confirmed by Contractor in writing.

Survival

The provisions of this section shall survive completion of the work, termination of the Contract, or expiration of any warranty period.
